Who We Are and Who We Want to Be: Episcopal Church Launches Deployment and Compensation Study

At the 2018 General Convention TransEpiscopal advocated for the passage of resolution D069, “Gather Annual Deployment and Compensation Data for LGBT and Gender Nonbinary Clergy.” Originally sponsored and endorsed by deputies Vanessa Stickler Glass at that time of the Diocese of California, and M.E. Eccles of the Diocese of Chicago, this resolution called for the gathering of data “using surveys and other mechanisms about: 1) the numbers of clergy who identify as lesbian, gay, bisexual, and/or transgender or gender nonbinary; 2) the deployment of such self-identified clergy, including whether their positions are part time, full time, or non-stipendiary; 3) their compensation, and 4) to broadly disseminate the report by electronic and other means.” Resolution D037 also called for an expansion of the annual “Clergy Compensation Report” to be able to analyze disparities on the basis of gender identity (specifically naming nonbinary in addition to female and male). We know anecdotally—indeed, from the experience of members of our own steering committee -- that there are LGBTIQ clergy who experience inequities and injustices in deployment and compensation. Stories of such experiences – such as that shared by Gwen Fry in a recent post -- are important and powerful. 
 
We believe that along with such stories, data can help us locate these stories within a larger story, by pointing the wider church to the systemic, structural issues that continue to require change. D069 and D037 complemented resolutions C029 and D005, which called for the maintenance of statistics on the race and ethnicity of those in bishop elections as well as all who are ordained “in order to show trends in ordination, deployment, and compensation by race and ethnicity, and to report broadly by electronic and other means.” This statistical collection and reporting was further described by C029 as part of the wider church’s process of “Becoming Beloved Community,” a framework emphasized by Presiding Bishop Michael Curry. 
 
In response to these resolutions, earlier this month an announcement came out: “The Episcopal Church invites all clergy to ‘Be a Part of the Picture’ as it seeks to Become Beloved Community.” The announcement calls for all clergy to participate in a study about the demographics, deployment, and compensation of clergy. 
 
To participate in the study, clergy are asked to go to this page of the Church Pension Group website and fill out a special section, “Information for Church Reporting.” The section heading explains, “the data collected on race/ethnicity, gender identity and sexual orientation will only be used for analysis and reported in aggregate form and will not be published or displayed on any public facing CPG website or printed in the Episcopal Clerical Directory. Individual data will be separated from data used to administer benefits.” 
 
Gender options in this section, which include an invitation to “check all that apply,” include “male, female, nonbinary” and then a “self-describe” write-in option, allowing for someone to write in trans specific language as best reflects their identity. 
 
Sexual orientation options in the form are more specific and expansive than what we have yet seen acknowledged in General Convention resolutions thus far: asexual, gay, lesbian, bisexual, heterosexual, pansexual, unsure, as well as a write-in option.
 
The Church Pension Group has also produced a video featuring leaders from across the church, including Presiding Bishop Michael Curry, who explains the importance of participating in this study: “I have a sneaking suspicion there’s an image of who and what the Episcopal Church is that may not conform to the actual reality of who and what the Episcopal Church is today. Having data really does help to inform us in terms of who we are and also in terms of who we want to be.” 
 
TransEpiscopal encourages all Episcopal clergy, particularly those who are trans and/or nonbinary, to participate in this study. We also appreciate all the effort that has gone in to bringing this process to fruition by so many behind the scenes. Aware as we are of trans people in the wider church who do not disclose this part of their history, we additionally appreciate the emphasis on confidentiality in this process, the promise that people’s information will not be shared without their consent. At the same time, several of us noted in updating our information that the Clerical Directory still does not have adequate public-facing, gender neutral options, whether in gender specific designations (e.g. it offers male or female only) or in titles. Particularly for those of us who are nonbinary identified and would like our entry in the Clerical Directory to reflect that truth, we ask CPG to expand the gender options for that public-facing directory. We consider such an expansion to align with resolution D090-2009 which encouraged “inclusive self-identification on all church data forms.”
 
We look forward to seeing the data produced by this study reflect more clearly who we already are and, as the Presiding Bishop put it, help give us more tools to assist the wider church in becoming who we want to be. Indeed, the Beloved Community God calls us to be.

In the Struggle Together

TransEpiscopal celebrates today’s landmark ruling by United States Supreme Court in Bostock v. Clayton County, Georgia, 590 U.S. ___ (2020) that Title VII of the Civil Rights Act of 1964 prohibits discrimination on the basis of gender identity and sexual orientation under the category of “sex.” It is now illegal in the United States for employers to discriminate against workers on the basis of gender identity and sexual orientation. This ruling confirms employment nondiscrimination laws that exist in various states around the country and adds protections for workers in more than half of the states that have previously had no such protections. 

We feel the support of our wider church, particularly from Presiding Bishop Michael Curry and President of the House of Deputies Gay Clark Jennings who were lead signers on an Amicus Brief that was submitted for this case on July 3, 2019. Thank you. Among the efforts of a range of religious traditions, that brief cites the work of several General Conventions in support of the full dignity of trans, nonbinary, and LGBQ people’s humanity. Thank you Vice President of the House of Deputies Byron Rushing for sponsoring resolution D012 in 2009, supported by Deputies Sarah Lawton of the Diocese of California and Dante Tavolaro of the Diocese of Rhode Island. That resolution put the Episcopal Church on record in support of non-discrimination legislation to protect trans people at the federal, state and local levels. We give thanks to the people of the Episcopal Church who answer “present” in the struggle for civil rights on behalf of trans and nonbinary people, as we live out our baptismal vow “to strive for justice and peace among all people, and respect the dignity of every human being.”

We also consider it important to acknowledge the particular contexts of struggle that today’s ruling has emerged out of and into. Title VII of the Civil Rights Act of 1964 prohibits discrimination on the basis of sex, race, color, religion, and national origin. It came into law because of the efforts of African Americans who struggled against racism for decades in the Civil Rights Movement. Today, we see the continuation of that struggle in the COVID 19 pandemic which is having disportionate health and economic effects on black and brown people in our communities. The struggle is continuing as well in the wake of the recent killing of George Floyd by police in Minneapolis, following the killing of Ahmaud Arbery in Georgia, Breonna Taylor in Kentucky, and on Friday Rayshard Brooks in Georgia. People around the country and the world are rising up to proclaim that black lives matter and that systemic racism, particularly its role in police brutality, must be eradicated. This is a history, a moment, and a movement with which trans and non-binary lives are bound up. The struggle very much continues. 

In addition, this ruling arrives on the heels of news from Friday in which we learned that the Trump administration had reversed protection for trans people and the wider LGBTIQ communities in health care. The Department of Health and Human Services (HHS) released a rule change that seeks to remove discrimination protection for LGBTIQ people in access to health care (specifically in Section 1557 of the Affordable Care Act). The rule change makes it all too easy for health care providers to claim that their acts of discriminatory exclusion are protected practices of “religious liberty." While this ruling is not shocking given the Trump administration’s ongoing efforts to erode legal recognitions and protections for trans people, it was demoralizing on a deeply challenging day.

News of the HHS rule change emerged as the community was attending to the fourth anniversary of the Pulse Nightclub massacre and absorbing the terrible news of the deaths of two more black trans women. Dominique Rem’mie Fells of Philadelphia and Riah Milton of Cincinnati had been killed last week within a twenty-four hour period, raising the number of anti-trans deaths in this country in 2020 to fourteen. The combination of trans misogyny and anti-black racism continues to be a horrific systemic pattern that we must eradicate. As marches in several cities proclaimed this past weekend, black trans lives matter.  

Such compounded, ongoing struggle makes today’s good news all the more important to embrace and to be fortified by as we continue to take up the critical work that remains to be done to fully make this world a place that respects the dignity of every human being. In these days of deep struggle, amid a time of social distancing, many in our community are feeling isolated, overwhelmed, and grief-stricken. Today’s news, emerging from and into an historic, ongoing, intersectional struggle, can remind us of the power of collaborative connection and solidarity. We are in this struggle together.

Edge of Our Seats

 We’re now on the edge of our seats waiting for resolutions D002 and D019 – the transgender nondiscrimination resolutions – to come to the floor of the House of Bishops (HoB). Since the Ministry Committee passed these two days ago we have been waiting for them to turn up in the HoB—they are on the supplemental calendar for day 2, and since the Bishops are a bit behind in their calendar, they haven’t come up quite yet. TransEpiscopalians sat in the HoB gallery last night and this morning, and will be back when the bishops go into open session at about 3:15pm.

Our work here has been buoyed by some wonderfulpreaching.  Yesterday Bonnie Anderson, President of the House of Deputies, preached an inspiring sermon based on the readings for the feast day of the martyred Czeck Reformer John Huss (c. 1369 – 6 July 1415).  You can watch the video and see the text here.  Her theme was courage:

“Courage animates all our virtues-honesty, confidence, humility, compassion, integrity, valor. Without courage, all these virtues lie dormant. There is no prescription for teaching courage. You may have noticed that courage 101 is not taught in school, or even in college, or even in seminary.”

She continued, 

“I can vividly remember the first time I stood up for something. I bet you can too. That memory becomes the story of a defining moment that is incorporated into our spiritual selves and becomes a cornerstone of our morality or our moral courage. If we are to reflect on our life, each of us can probably name today, events and people who helped to shape our moral courage. Moral courage defines us at our core and prompts us to act in spite offear.”

I left the service strengthened for the day ahead.  As we did yesterday, several of us readied ourselves to testify at a committee hearing.  This time it was D022, a “Churchwide Response to Bullying.”  I spoke in support of it in my capacity as an Episcopal Campus Minister.  Before the day was out, the committee had reported it out tothe House of Bishops.

Then this morning Bishop Michael Curry of the Diocese of North Carolina, assigned the lection in celebration of the life of the novelist and abolitionist Harriet Beecher Stowe, preached a soul-stirring sermon on how being a prophetic Christian requires a certain kind of insanity. Watch and/or read it here.  Citing the gospel passage from June 10th(Mark 3:20-35) in which Jesus’ family comes to find him and declares him “out of his mind,” Bishop Curry proclaimed, 

“forgive me for saying it this way,but Jesus was, and is, crazy! And those who would follow him, those who would be his disciples, those who would live as and be the people of the Way, are called and summoned and challenged to be just as crazy as Jesus. So I want to speak on the subject, ‘We Need Some Crazy Christians.’”

I couldn’t help myself—I just had to tweet, to share, what I was hearing.  Over the next several minutes my twitter account posted:

I haven’t been able to get the Seal song out of my headsince (and now it’s in yours… sorry).

After the service I flipped over my name tag and wrote

As I left the worship space I found myself wondering, will the bishops make the connection between Bishop Curry’s inspiring message and the trans nondiscrimination resolutions? Are they willing to be “crazy” enough – as some may well deem them within this church and beyond– to embrace the ministries of its transgender members, lay and ordained? Are they willing to take that leap?

This morning TransEpiscopal members and supporters sat inthe HoB gallery. The bishops did not quite get to our resolutions, but we return to the gallery now with hope in our hearts.

"This Is Important"

Yesterday, for the first time in its history, the House of Bishops publicly took up the matter of transgender people in ordained ministry in the Episcopal Church. Resolution C061, which passed the House of Deputies on Monday, July 13th by a wide margin, seeks to change Title III.1.2 which currently forbids discrimination on the basis of the following categories: “race, color, ethnic origin, national origin, sex, marital status, sexual orientation, disabilities or age, except as otherwise provided by these Canons.” The resolution would add “gender identity or expression” to that list. The outcome of this debate reflected a diversity of opinion on and experience with transgender people in the House of Bishops. Several bishops spoke in support of the resolution, a couple spoke strongly against it, and a number referred to feeling inadequately educated on the topic.

The resolution, as they initially received it was a follows:

Resolved, the House of _______ concurring, That Title III, Canon 1, Sec. 2 of the Canons of the Episcopal Church is hereby amended to read as follows: all baptized persons shall have full access to the discernment process for any ministry, lay or ordained in this church, except as otherwise provided by these canons. No person shall be denied access or have their discernment process terminated because of race, color, ethnic origin, national origin, sex, marital status, sexual orientation, gender identity or expression, disabilities or age, except as otherwise provided by these Canons. No right to licensing, ordination, or election is hereby established.

Marc Andrus of the Diocese of California and Gene Robinson of New Hampshire spoke both passionately and authentically about their experience of transgender people in ministry. Bishop Andrus emphasized that in his diocese, where Vicki Gray serves as a vocational deacon, they ordain individuals, not particular classes of people. If someone discerns a call to ministry, the issue for a Commission on Ministry and bishops to attend to is the vocation and the person’s ability to live into it, not their particular gender identity or expression. I entered the room during the tail end of Gene Robinson’s remarks, and so missed the bulk of them, but I heard him speaking strongly in support. 

Of those who spoke against, Bishop Duncan Gray of Mississippi stood out for remarking that adding this language would “cross a line” and that we don’t need it because people are ordaining trans people already without it; to make that reality canonically explicit would be to “wave a red flag” about it.

For the most part, among those who spoke against the resolution, what I heard was not so much outright negativity as a sense of discomfort, of feeling overwhelmed and inadequately informed. A couple bishops argued that Commissions on Ministry need to have access to resources in order to be prepared to receive applications to the ordination process from trans people, and that to change the canon now, before they had such resources, would not be fair. 

Bishop Dorsey Henderson of the diocese of Upper South Carolina objected to the longstanding language of the canon “no person shall be denied access”. He expressed a wish that the word “all” might replace “no.”  

Bishop Samuel Howard of the Diocese of Florida expressed confusion and concern about the term “gender expression,” wondering if it might be a trojan horse for sexual activity outside of marriage. This was not the first time someone took issue with this term; someone on the floor of the House of Deputies also asked about it, and it also came up in the Committee on World Mission.  

Bishop Dabney Smith of Southwest Florida then objected to a line that the Committee on World Mission had actually added to the original version of the resolution. The nondiscrimination canon already states that “no person shall be denied access,” but this resolution added the phrase “or have their ordination process terminated.” Had it remained, this line might have been a remarkable achievement in its own right. It would have addressed scenarios in which people come out as LGB or T, or begin a relationship, after entering their ordination process; in a some more conservative dioceses, people’s processes have indeed been terminated in response to just such situations. But the bishops were not in favor of that phrase. Stated reasons ranged from exactly the one just mentioned to concerns about opening themselves to litigation if, for instance, someone attributed the reason for their termination to a particular bias while the bishop or Commission on Ministry might have actually had other reasons.  

The bishops then unanimously voted to remove that phrase.

Bishop Catherine Roskam of New York then returned to Bishop Henderson’s critique of the “no person” language. “What is it about ‘all’ that we don’t understand?” she asked. “There’s no adequate list. There will always be someone’s name we’ve left off.” With that, she made an amendment to remove all of lines five and six of the resolution. That motion spoke not simply to the language of “gender identity or expression,” but also to the entire list already enshrined: race, color, ethnic origin, national origin, sex, marital status, sexual orientation, disabilities or age. The move on Bishop Roskam’s part appeared designed to find a way out of an impasse, a way not to reject the resolution outright.

In the wake of this move, Bishop Michael Curry of North Carolina made a motion to refer the resolution to the Standing Commission on Ministry Development, so that a study could be done on ordaining transgender people. Notable in his motion was the sentiment, “This is important. It is important. And it’s of such importance that we want to do this properly, we want to do this in the right way. And in order to do so we need to come back with a good, thoughtful report.”  

Comments and questions that followed either supported this referral or asked whether it would cause the original resolution to die. A vote was then taken on Bishop Curry’s motion, and was very narrowly defeated: 60 in favor, 66 against.

They then immediately turned to Bishop Roskam’s amendment, passing it, and the resolution as amended:

Resolved, the House of _______ concurring, That Title III, Canon 1, Sec. 2 of the Canons of the Episcopal Church is hereby amended to read as follows: "all baptized persons shall have full access to the discernment process for any ministry, lay or ordained in this church, except as otherwise provided by these canons. No right to licensing, ordination, or election is hereby established."

Because they amended the resolution, it gets sent back to the House of Deputies.

So, where does this resolution leave us? While I believe the amendment to remove the specific demographic language was well intentioned, and while I certainly concur with the notion that “all” should truly mean all, this resolution as amended does not do what it was designed to do.  The “all” version appears to have passed specifically because it did not mention “gender identity or expression.” Further, it eradicates the particularity of groups that worked for years to get that language into the canon to begin with. As much as I wanted the universality of “all” to do the job, in the context of this debate as it unfolded, the term was more evasive than inclusive. And so my hope is that the House of Deputies will not concur with it, that we might put our shoulders to this particular wheel again at the 77th General Convention.  

But I have much higher hopes than that. The progress we have made at this Convention-- with more to come before it's over-- is absolutely huge. The fact that the House of Deputies passed C061 by a very respectable margin is tremendous. That the House of Bishops got to discuss this resolution was huge. They made it clear they want to learn more, which is also to me a major victory. I will admit, however, that it was also difficult, indeed painful, to hear the debate as it unfolded. This is my life, my ordination process, my ministry they were talking about. And yet at the same time, in my mind, I keep coming back to Bishop Curry saying “This is important. This is important.” I agree-- it is important, and because of that, we need to do more. We have taken some of the first steps in making the Episcopal Church and Anglican Communion aware that trans people are here, in our pews, on our vestries, in our pulpits; that we bring unique insights, gifts of uncommon experience and perception, and often deeply prayerful experiences of transformation; that we love this church.  

And while I’ll end this post here, as Michelle and Donna have noted, more trans related activity happened yesterday than just this vote—in the afternoon the House of Deputies took up D012, the transgender civil rights resolution, and passed it in a landslide after several truly beautiful speakers gave testimony. I want to give that story a blog post in its own right, so stay tuned.
